Wednesday, October 10th, 2007

Question: I am currently a student and am receiveing osap. I am finished my program in April. I have paid my tuition (from osap) but will be receiving the second amount in january.I am exploring all my options but if i claim bankruptcy will I still reveive the 2nd amount. I have been accepted for osap and realize that I can not claim bankruptcy against this loan.

Answer: Yes, in most cases OSAP will still lend you money while bankrupt. They will require a letter from your trustee confirming that you will be repaying the money.

Question: Can the collection agency that currently holds my student loan in Toronto garnishee my wages if I now live and work in the United States?

Answer: To garnishee wages in the United States that would have to sue you and get a judgement against you in the United States, which is an expensive procedure, and therefore unlikely to happen.

Hi I am on a permantent disablity via ODLP, and my student loans about to reach the 10 yr mark, I am hoping to declare bankruptcy on them but have been told that the fee will be over 200/mth for the 9 mths following the filing, is this true and is there any way I can declare with a lower monthly fee due to undue hardship, or is there any community programs to assist in the regards??
