Spouse’s Debts During Bankruptcy in Ontario

Question: My husband will be filing for bankruptcy in Ontario soon and we’ve been told by our bankruptcy trustee that since he is secondary on my credit card that we can claim that debt to be covered as well (minimal outstanding balance). She assured us that this will not affect my own credit rating, but this sounds a bit fishy to me. Why, then, would he not be named on our other family member’s debts (line of credit, etc) so that theirs could be wiped out, too? And what affect will this have on my accounts?

Answer: If a husband and a wife are joint on a credit card, and the husband goes bankrupt, the husband is discharged from the debt; the credit card company can no longer attempt to collect money from the husband. However, the wife has not filed for bankruptcy, and therefore she remains fully liable for the entire debt.

Leasing a vehicle and bankruptcy in Ontario

Question: If you are leasing a vehicle does it affect that lease if you go bankrupt?

Answer: In most cases, if you go bankrupt in Ontario, you can keep your leased vehicle, provided you continue to make the lease payments. The decision is left to the leasing company; if you are a good customer, they will normally allow you to continue to make payments. If you are behind on your payments, they may ask you to return the vehicle.

Each leasing company has different policies, so we suggest that you contact an Ontario bankruptcy trustee for more information.

Student Loans, OSAP, and Bankruptcy In Ontario

Question: I am currently a student and am receiveing osap. I am finished my program in April. I have paid my tuition (from osap) but will be receiving the second amount in january.I am exploring all my options but if i claim bankruptcy will I still reveive the 2nd amount. I have been accepted for osap and realize that I can not claim bankruptcy against this loan.

Answer: Yes, in most cases OSAP will still lend you money while bankrupt. They will require a letter from your trustee confirming that you will be repaying the money.
