401 K and bankruptcy in Ontario


My wife works in the U.S. and would like to know if her 401K is protected in the U.S. or if it is seizable if she goes bankrupt in Ontario?

9 month discharge


My mother filed for bankruptcy a few years ago. She said she had to pay for 9 months + an additional 12 months after her discharge. What was this for?

Also, has bill c-55 come into affect yet?

Bankruptcy, Banking and Loan Co-signers


My husband and I are filing for bankruptcy. After crunching all the numbers, it is our only option. We do, however, have a co-signer for a student line of credit. I suppose my questions are:
1. How does this affect the co-signer?
2. Is it true we can't maintain accounts at our bank after the bankruptcy? Is it also true that we can't bank at the same institution as our co-signer?

deadbeat bankrupt husband


My husband left me and my 2 children last year. He didn't pay any of his part of the debts that were agreed upon in the seperation agreement. When collection agencies started calling he declared bankruptcy and I am now left with $50,000 of his debt. He hasn't paid a cent for his children in a year and now wants his passport so that he can take his girlfriend on holiday. I only make $25,000 a year, is there any way that I can sue him for this debt.

How is the surplus income calculated. Im already in bankruptsy but have more than the required allowed now. How much more would i have to pay at the end of my bankruptsy. Im already paying 200.00 a month now. Am making 3400.00 take home a month for a family of 3.

Can't afford trustee fees


Today I had a consultation with a trustee regarding bankruptcy proceedings. I explained that I was on welfare (Canada Works) and had absolutely no extra money for fees and costs. I was told that unless I could come up with thirteen hundred dollars now and one-hundred and seventy-five dollars per month, that I could not proceed with bankruptcy and should just ignore my creditors. Is there another alternative?

Student Loan/Single Mother


I requested interest relief on my $60,000 student loan and was told I make too much money. I only make 3,500/month gross and have to pay $1,000 in rent alone. My credit cards are maxed out and I have $10,000 line of credit. I only make minimum payments on these. I don't understand why they only look at my salary and don't consider my other debts and dependents. Any ideas would be greatly appreciated. Thanks

11 year old promissory note=bankruptcy?


Promissory note to grandmother in 1995 for $25,000. She passed away in 1996.
My brother who was executor of her estate is now demanding payment plus interest.
First time request/demand ever made.
Is this still enforceable?
If so, would I be able to declare bankruptcy ?
