I should be recieving my discharge papers but it seems my husband is in for another 6 months. My husband is looking for a new job as his has been eliminated. They are still paying him (floating to help out) so he does have a job for the momment. He may have an opportunity to take a job in the USA. I might have to stay and get things organized (two children) and leave after Chirstmas. In the mean time I will live in our house and he will have to get an apartment. Is there any allowence given now that there will be two households to live in. Not sure if we can do it otherwise but then if he doesn't have a job and won't be able to afford a house anywhere.

The short answer is that there is no specific allowance when calculating surplus income if you are required to live away from home for work. However, the trustee does have the ability to alter the surplus income payments in unusual circumstances (although the trustee may require court approval to do it). I suggest you contact your trustee and explain the situation, and show them specific examples of what it is costing you to live; the trustee can then decide on a course of action. The trustee may be able to reduce the payments, or may be able to extend the bankruptcy for a period of time to allow you to make the payments. If you disagree with the trustee's decision you have the right to request mediation, or a court hearing to decide the matter.
