What to do after a consumer proposal

Posted on Tuesday, July 25, 2006

I just successfully completed a 5 year consumer proposal and find myself in no better position than when I filed. The collection agency is after me for my Canada Student Loans. I was told by my creditor upon completing the consumer proposal that considering my student loan debt is 10 years old now I could apply to the court to have the debt expunged. The collection agency is now telling me that I don't qualify for such a break. Who is telling me the truth?

Not surprisingly, the collection agency is not telling you the truth. If the student loan is more than 10 years old, you can apply to the court. Your trustee has probably done this a number of times, and therefore can probably assist you with this process. It will be up to the court to decide if the debt is discharged.
