how to claim bankruptcy when I have equity in a house

Saturday, April 1st, 2006

I am in a financial position where i have to claim personal bankruptcy but I have equity in a home owned by my ex spouse and I. He lives in the home with my oldest child and has no means of financing to buy me out. My equity in the home is about 20000.00 and he is self employed and cannot get a loan. The home is assessed at about 90000.00 with mortgages of about 49000.00. I’ve been told I cannot file for bankruptcy until I get this equity but I have creditors wanting to sue me and garnish my wages. I am a single mom and I’m lost…..please help. What can I do?
